According to Jon Crusey, City Manager, the City attempted to discuss the settlement of the case with the defendants prior to the appeal deadline. Unfortunately, the defendants were non-responsive to the City’s overtures and the City had to file its Notice to Appeal because of time limitations. The defendants filed their Notice of Appeal thereafter.
These legal actions will take the City’s case on the “Mad Professor” before the Ohio Supreme Court who will then determine the constitutionality of the City’s claims. While several City Council members who won in November promised to not use City funds to sue local businesses like Warrior, the majority of council members continue to desire to go for a win, this time before the highest court in the state.
